Article 2 According to the characteristics of the construction project and the environmental sensitivity of the area, comprehensively consider the possible impact of the construction project on the environment, and implement classified management of the environmental impact assessment of the construction project.
The construction unit shall, in accordance with the provisions of this directory, organize the preparation of the construction project environmental impact report, environmental impact report form, or fill in the environmental impact registration form.
Article 3 The environmentally sensitive areas mentioned in this list refer to the legally established protected areas of various levels and types and areas that are particularly sensitive to the environmental impact of construction projects, mainly including the following areas:
(1) National parks, nature reserves, scenic spots, world cultural and natural heritage sites, marine special protection areas, drinking water source protection areas;
(2) Except for (1), the scope of ecological protection red line control, permanent basic farmland, basic grassland, natural parks (forest parks, geological parks, marine parks, etc.), important wetlands, natural forests, and key protected wildlife habitats, key points Protect the growth and breeding grounds of wild plants, natural spawning grounds, feeding grounds, wintering grounds and migratory passages for important aquatic organisms, natural fishing grounds, key prevention areas and key control areas for soil erosion, and sandy land closure protection
Zones, enclosed and semi-enclosed sea areas;
(3) Areas whose main functions are housing, medical and health care, culture and education, scientific research, and administrative offices, as well as cultural relics protection units.
The environmental impact report and environmental impact report form should focus on the impact of construction projects on environmentally sensitive areas.
Article 4 The construction unit shall determine the environmental impact assessment category of construction projects in strict accordance with this catalog, and shall not change the environmental impact assessment category without authorization.
The construction content involves the construction projects of two or more project categories in this list, and the environmental impact assessment category is determined according to the highest single item level among them.
The construction content does not involve the reconstruction and expansion of the main project, and its environmental impact assessment category is determined according to the content of the reconstruction and expansion.
Article 5 Construction projects that are not specified in this list shall not be included in the management of environmental impact assessment of construction projects; if the provincial competent department of ecological environment considers construction projects that are not specified in this list to be included in the management of environmental impact assessment of construction projects, they may According to the characteristics of pollution factors and ecological impact factors of the construction project, and the sensitivity and sensitivity of the environment in which it is located, suggestions for classified management of environmental impact assessment are put forward, which will be implemented after being confirmed by the Ministry of Ecology and Environment.
Article 6 The Ministry of Ecology and Environment is responsible for the interpretation of this catalog, and it will be revised and announced in due course.
Article 7 This list will come into effect on January 1, 2021. The "List of Classified Management of Environmental Impact Assessment for Construction Projects" (Order No. 44 of the Ministry of Environmental Protection) and the "Decision on Amending Part of the "List of Classified Management of Environmental Impact Assessment of Construction Projects" (Order No. 1 of the Ministry of Ecology and Environment) shall be repealed at the same time.
